AccuSourceHR's 2023 Mid-Year Compliance Update

Just like that and 2023 is almost half over. The year has brought new developments impacting the background screening industry and the services background screeners provide. Concerns over privacy continue to sweep across the nation, creating an ever-growing patchwork of state laws. The Department of Transportation has taken a new stance that may make regulated drug screening easier for covered employers. The rights of marijuana users continue to be explored by courts, and new laws provide additional protections for those who legally use it. Legislatures continue to focus on pay equity and transparency and seek to provide increased equal footing to those with past criminal records.

In this mid-year compliance webinar, we will review the latest pay transparency requirements as well as new ban-the-box and fair chance laws, including recent Clean Slate laws impacting the background screening industry and employers alike. New privacy laws have passed in 2023. We will explore what to expect in the privacy arena for the remainder of the year and into 2024. Marijuana and drug screening continue to be an ever-evolving topic. We will also review the Department of Transportation’s permitted use of oral fluid testing for positions regulated under its purview. Finally, our mid-year update will conclude with a discussion of areas to watch for the balance of 2023 and best practice recommendations to consider as you build and maintain compliance programs.
